The North Dakota Racing Commission is the regulatory body in charge of regulating live and simulcast racing in North Dakota and administers three special funds for the benefit of the horse racing industry in North Dakota. The Commission is made up of five members appointed by the Governor and has an office staff of an Executive Director and Administrative Officer. The office is located at 4501 Coleman Street, Suite 100, Bismarck ND 58503-0996.

Breed Fund Rule Changes - effective October 1, 2022
The Administrative Rule change to the Breed Fund was approved and adopted on October 1, 2022. All of the Breed Fund forms have been updated to reflect these changes. Please use the new forms that are located at the bottom of the Breeders Fund page. If old forms are submitted, they will be unrecorded and returned to you.
The major changes are:
1. The registration fee for a foal, broodmare, or stallion is now a one-time fee of $30. Once the horse has been registered in the breed fund, there is not any additional fees to be paid. The paperwork must still be submitted to register a broodmare or stallion, if they were registered as a foal.
2. If you want to register a foal after December 31 of their foaling year, the late fee will now be $300.
3. If you utilize embryo transfer with a broodmare, there is a form that must be completed and submitted by November 1 of the breeding year. The form is called Recipient Mare Request (SFN 62243). The form is at the bottom of this page. This change will be effective for the calendar year 2023.

ND Breed Fund Foal Registration Change
Per action of the Racing Commission at the November 21 meeting, the Commissioners authorized a fee reduction for foals that are registered after their foaling year. Effective immediately, yearlings and older foals may be registered in the North Dakota Breed Fund for $250. The fee remains the same at $10, if the foal is registered by December 31 of their foaling year.

Per the motion of the ND Racing Commission at the November 21, 2019 meeting, the Commission has authorized offering a reduced fee on any license applications received sufficiently in advance of the 2020 racing season. Breed Fund Registration Fee Change for 2017
Per action of the Commission at the April 21 meeting, the Breed Fund Registration reduced fee schedule for Foals will end December 31, 2016. Beginning January 1, 2017 the fees for Foal registration shall be in accordance with Admin. Rule 69.5-01-09-02(4) which provides:
- Registrations postmarked no later than Dec. 31 of the foaling year shall be $10
- Registrations postmarked after Dec. 31 of the foaling year shall be $1,000
This return to the letter of our regulations is intended to prevent possible fraud and support investigation of Foal registrations to protect ND horsemen's Breed Fund. Please make sure to put in your Foal registrations promptly and contact Breed Fund Administrator, Sally Dasinger at 701-751-0809 with any questions.

In-State Racing
$225,000 has been made available by the ND Racing Commission from the ND Breed Fund to provide breeders awards for 2016 in-state racing. The in-state minimum guaranteed Breed Fund pool of $150,000 has been extended an additional year through 2019.
Out-of-State Racing
$50,000 has been made available by the ND Racing Commission from the ND Breed Fund to provide breeders awards for ND-breds racing in out-of-state races. The following rules apply:
- Points will be awarded January 1 through June 2 and August 5 through October 30, 2016;
- No out-of-state points will be awarded for races held June 3 through August 4, 2016;
- Distributions shall be in accordance with current in-state rules;
- It is the responsibility of the foal/mare/stallion owner to provide the Commission with out-of-state race results;
- Only official race results from Equibase, Daily Racing Form, or Trueform Racing Services will be accepted and must be sent to the ND Racing Commission Office;
- All results must be postmarked no later than October 31, 2016.
No out-of-state points can be awarded for dates beyond October 30, 2016 due to NDCC 53-06.2-11(6) which requires that Breed Fund money needs to be distributed in the same calendar year it is earned. In order to comply with this state statute, the Breed Fund administrator needs the last month and a half to two months in order to calculate awards. In order to alleviate this problem a change to statute would be required.

Notice to Horsemen
Effective January 1, 2016: Pursuant to Administrative Rule 69.5-01-09-02(4)(g) a foal registered by an owner who does not reside in North Dakota must be inspected by a North Dakota state-licensed veterinarian at the expense of the owner. A copy of the Racing Commission’s Veterinarian Certificate for Out-of-State Owners form can be found on the Commission website on the Horsemen/Breeders Fund tab. While enforcement of this rule may have been lax in the past, the rule will be strictly enforced for any foals registered on or after January 1, 2016. Any registration for a foal with an out-of-state owner not accompanied by the certificate of inspection will be rejected.
Early Racetrack License Application - Reduced Fee Schedule
Per the motion of the ND Racing Commission at the November 5, 2015 meeting, the Commission has authorized offering a reduced fee on any license applications received sufficiently in advance of the 2016 racing season. The license fee reduction will apply to any application meeting the following criteria:
- A completely filled out application;
- A check or money order payable to the NDRC for the applicable fee;
- Application and fee postmarked by April 30, 2016.
2015 ND Bred Program
In-State Racing
$150,000 has been made available by the ND Racing Commission from the ND Breed Fund to provide breeders awards for 2015 in-state racing.
Out-of-State Racing
$30,000 has been made available by the ND Racing Commission from the ND Breed Fund as a "test fund" to provide breeders awards for ND-breds racing in out-of-state races. The following rules apply:
Points will be awarded April 30 through May 31 and August 1 through September 30, 2015;
No out of state points will be awarded for races held June 1 through July 31, 2015 (Chippewa Downs Meet);
Distributions shall be in accordance with current in-state rules;
It is the responsibility of the foal/mare/stallion owner to provide the Commission with out-of-state race results;
Only official race results from Equibase, Daily Racing Form, or Trueform Racing Services will be accepted and must be sent to the ND Racing Commission Office;
All results must be postmarked no later than October 15, 2015.
Notice to Horsemen
Effective January 1, 2015, all broodmares must be registered as a broodmare before foaling a ND-bred eligible horse.

Cobalt Rule
At its May 28, 2015 meeting the North Dakota Racing Commission, pursuant to Admin Rule 69.5-01-02-01(2), modified its medication rules to include the regulation of cobalt as follows:
No penalty for cobalt concentrations of less than 25 parts per billion (ppb) of blood serum or plasma.
For cobalt concentrations of 25 ppb or greater but less than 50 ppb of blood plasma or serum the recommended penalty is a written warning or fine and the placement of the horse on the Veterinarians List with removal from list only after a blood test confirms that the concentration is below 25 ppb of blood plasma or serum. Testing shall be paid by the owner(s) of the horse.
Concentrations of 50 ppb or greater in blood plasma or serum have a recommended “B” penalty.
